Terms and conditions
1. Scope of Application
The buyer enters into a legally binding purchase contract with the company:
Helvetic Shop GmbH
Espenstrasse 135
CH – 9443 Widnau
Switzerland
Tel.: +41 71 372 00 22
E-Mail: info@helvetic-shop.com
(hereinafter referred to as the "seller") and the customer/buyer (hereinafter referred to as the "buyer"), acknowledging the following terms and conditions. The applicability of other general terms and conditions is excluded, even without explicit objection. Additional agreements are only binding if confirmed in writing. We will only recognise terms that contradict or deviate from our terms and conditions if we have explicitly agreed to them in writing. Verbal statements are non-binding without written confirmation. The contract language is German.
2. Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer. Product images, texts, and data sheets may vary and are not binding. The buyer selects items from the online assortment, which they submit to the seller via email by confirming their shopping basket in the online shop. The seller confirms the shopping basket by automated email, thereby making the purchase legally valid.
2.2 The seller reserves the right to reject the buyer’s offer in exceptional cases, for instance, if the product is unavailable or if delivery is refused due to outstanding payments by the customer. Additionally, for "purchase on account," a credit check may be carried out; if the seller deems the result unsatisfactory, they reserve the right to deliver the goods only after the buyer has made an advance payment.
3. Prices
3.1 All prices stated are final prices in Swiss francs (CHF) and include the statutory VAT of 8.1%. These are fixed offer prices valid for the duration of the respective offer. Prices become legally binding upon confirmation by the seller via email.
3.2 The customer may pay in advance, by credit card (MasterCard, Visa, American Express, etc.), PayPal, TWINT, or on account.
3.3 Service fees apply for payments via PayPal and credit card (MasterCard, Visa, American Express, etc.), amounting to 2.4% of the ordered goods' value (excluding shipping costs). The percentage may vary and change at any time without prior notice. The service fees are always borne by the buyer.
4. Delivery and Shipping
4.1 Delivery is made within Switzerland to the address specified by the customer unless otherwise agreed. If the customer provides an incorrect delivery address, delivery may not be possible. Any resulting costs will be charged to the customer.
4.2 Shipping costs per order:
- A-Post: CHF 9.-
- Express delivery: CHF 22.50 (per parcel up to 30 kg). Guaranteed next-day delivery by 9:00 am, including Saturday delivery (additional charges for express deliveries are borne by the customer).
All price indications are guideline prices and may change at any time without prior notice.
Free shipping applies for orders over CHF 300.00 net (excluding deliveries outside Switzerland).
Self-collection (free of charge) from our warehouse is also possible – our opening hours:
Monday–Friday
07:30 am – 12:00 pm
01:00 pm – 05:00 pm
The buyer will be informed by the seller about the collection date.
4.3 Delivery times are non-binding unless a fixed delivery date has been explicitly agreed in writing.
4.4 The delivery of ordered goods is subject to availability and the possibility of reordering from our suppliers. If an item is unavailable, we will manufacture or order it upon request in consultation with the buyer. The buyer receives an individual confirmation via email when placing the order. The order is only deemed accepted upon shopping basket confirmation. In such cases, the customer will be informed immediately and offered a comparable product. If no comparable product is available or the customer does not wish to receive one, the seller will promptly refund any payments made by the customer.
5. Payment / Payment Default, Reminder Fees & Debt Collection
5.1 Payment is made either in advance, via PayPal, TWINT, credit card (MasterCard, Visa, American Express, etc.), or on account unless otherwise agreed.
5.2 The purchase price is due immediately upon conclusion of the contract. If the customer defaults on payment, the seller is entitled to charge interest on arrears at the legally stipulated rate. Goods purchased on account must be paid within 14 days without deductions.
5.3 Helvetic Shop GmbH charges an administrative fee of CHF 10.- for the second reminder and CHF 30.- for the third reminder. If reminders remain unsuccessful, the case will be handed over to a debt collection agency. In this event, an effective annual interest rate of up to 15% on the outstanding invoice amount from the due date may be charged. The commissioned debt collection agency will claim the outstanding amounts in its own name and at its own expense and may impose additional processing fees.
Payment processing information may be forwarded to the Swiss Creditreform Association.
6. Retention of Title
Delivered goods remain the property of the seller until full payment has been made and must be treated accordingly. Ownership transfers to the buyer only upon expiry of the withdrawal period or the return period, provided the goods have been fully paid for.
7. Right of Withdrawal
7.1 For all purchases of our products via our online shop, the seller grants the buyer a voluntary right of withdrawal for 8 days after receipt of the products, without the need to provide reasons. The buyer may withdraw from the contract within 8 days after receiving the goods by returning them to us or by notifying us of the withdrawal via email:
Helvetic Shop GmbH
Espenstrasse 135
CH – 9443 Widnau
Switzerland
E-Mail:
info@helvetic-shop.com
The 8-day return period begins the day after receipt of the goods (as confirmed by Swiss Post) and is deemed met if the goods or withdrawal notice are handed over to the post office or another transport company on the last return day. After the withdrawal period has expired, the purchase contract becomes legally binding.
The exercise of the right of withdrawal is contingent upon the buyer returning the goods unused, complete, intact, and in their original packaging. The goods must be sent back to the address mentioned above.
7.2 The return of a product is at the customer’s expense and risk. Please ensure you obtain confirmation of your return and keep it safe. In the event of parcel loss, your return can only be credited upon presentation of this document.
In the case of proper return of the goods, we will refund the price paid by the buyer in full or partially within 14 days from the day the goods are received by us. The following information applies to the amount of the refund:
The item is returned in unopened original packaging:
If returned unopened within the return period, the full purchase price will be refunded minus shipping costs. For orders that qualified for free shipping, a shipping fee of CHF 9.00 will be deducted from the refund.
If the buyer is responsible for the deterioration, damage, or other depreciation of the goods, they must compensate for the value. If the returned goods are damaged or no longer resalable, we reserve the right to make claims for depreciation or compensation.
The refund will be made using the originally used payment method and will always be transferred to the associated account that was used for the payment, unless something different has been explicitly agreed with the buyer. The buyer must ensure they have access to the specified bank account, as the seller assumes no liability in this regard. The refund will be processed within 14 days of receiving the goods by the seller.
8. 8. Refusal of Acceptance / Order Withdrawal
8.1 If the buyer refuses to accept the ordered goods without having cancelled the order before leaving our company, we will charge an administration fee of 10% of the goods' value, but at least CHF 20.00. If the buyer falls behind with the payment for the goods, we will charge fees for each reminder. We reserve the right to seek further compensation claims and legal actions. If the buyer partially or entirely withdraws from an offer, we are entitled to charge 5% of the goods' value, but at least CHF 20.00 as an administrative fee.
Information regarding the payment processing may be forwarded to the Swiss Association Creditreform.
9. Warranty / Liability for Defects
The statutory warranty liability applies according to the Swiss Code of Obligations (OR).
In the case of justified complaints, the buyer has the right to request rectification, exchange, or credit within the scope of the warranty claim. In cases of warranty, please contact us in writing or by phone at:

Exception: Information about the payment processing may be forwarded to the Swiss Creditreform Association.

12.3 The place of jurisdiction is the company’s registered office in Switzerland.
